End User Agreement

1. Acceptance of Terms

By accessing and using GulpGoals ("the Service"), you agree to be bound by this End User Agreement ("Agreement"). If you do not agree to these terms, you may not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Medical Disclaimer

Users with POTS (Postural Orthostatic Tachycardia Syndrome), heart conditions, or other medical concerns should work with their healthcare provider before using features related to hydration, salt intake, or symptom tracking.

3. User Responsibilities

You agree to:

• Provide accurate and complete information during registration and account setup
• Maintain the confidentiality of your account credentials
• Use the Service in compliance with all applicable laws and regulations
• Not engage in unauthorized access, hacking, or misuse of the Service
• Not upload or transmit viruses, malware, or harmful content
• Use data logging features responsibly and truthfully

4. Data Privacy and Security

Your personal health and activity data is treated with strict confidentiality. We implement industry-standard security measures to protect your information. You own your data and have full rights over it: you may export a complete copy of all your data and permanently delete your account at any time, directly within the app — no support request required. 5. Subscription and Billing

Some features of GulpGoals are available through a paid subscription ("Pro"). By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing cycle, and no refunds will be issued for unused portions of your subscription.

We reserve the right to change subscription pricing with 30 days' notice. Continued use of the Service after pricing changes constitutes acceptance of the new pricing.

6. Intellectual Property

All content, features, functionality, software, code, designs, branding, text, graphics, logos, names, trademarks, and any other app-related materials — including the GulpGoals application itself and everything associated with it — are the exclusive property of GulpGoals and gulpgoals.com. All rights, title, and interest in and to the app and all app-related things are owned by and reserved to GulpGoals (gulpgoals.com).

All such property is protected by copyright, trademark, patent, trade secret, and other applicable intellectual property laws. You may not reproduce, copy, distribute, transmit, display, modify, reverse engineer, sell, or create derivative works from any app-related content without the express written permission of GulpGoals.

No portion of the app or any app-related materials may be used, copied, or repurposed in any way without express written authorization from GulpGoals. All rights not expressly granted to you in this Agreement are reserved by GulpGoals and gulpgoals.com.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GULPGOALS AND ITS OWNERS, OPERATORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you shall not exceed the amount you have paid to us in the 12 months preceding the claim, or $100, whichever is greater.

8. Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Dispute Resolution

Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, except that each party retains the right to seek injunctive or other equitable relief in any court of competent jurisdiction.

Arbitration shall take place in Denver, Colorado, and shall be governed by the laws of the State of Colorado without regard to its conflict of law principles.

10. Termination

We may terminate or suspend your account and access to the Service at any time, with or without notice, if you violate this Agreement or engage in conduct that we believe is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately.

11. Third-Party Services

GulpGoals may integrate with third-party services and APIs. We are not responsible for the availability, accuracy, or functionality of these third-party services. Your use of third-party services is subject to their own terms and privacy policies.

12. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

This Agreement constitutes the entire agreement between you and GulpGoals regarding the Service and supersedes all prior agreements, understandings, and negotiations. No oral or written agreement not contained herein shall be binding on either party.
